Easements vs. License Agreements

When we’re insuring an easement, we have to determine that we’re dealing with an easement rather than a permit or a license agreement. A license agreement it is something that is generally terminable at-will or it could be terminable upon something that’s agreed-upon within the agreement itself, whereas an easement tends to be perpetual. It could be for a longer-term but we usually think of easements is being perpetual.

Usually, a license agreement is a permission to use someone’s property temporarily until the grantor decides to terminate the agreement. There could also be some occasion in the agreement that would result in termination – perhaps if the grantee fulfills some requirement in the near future.

It generally does not run with the land, whereas an easement would run with the land.
