Many people have questions about what goes on behind the scenes during the title underwriting process. One of the most important aspects of title underwriting is the title examination. In this article, we are going to discuss what happens during a commercial title examination.

The Goal of a Title Examination

Before we dive into what happens during a title examination, let’s briefly talk about why we do them in the first place. The ultimate goal of a title examination is to comb through the entire history of title for a given property and identify any potential issues that could impact the future property owner or lender. Such issues could include title defects or clouds like missing signatures, incorrectly filed documents, tax liens, and more. It’s crucial that these items are identified and taken care of before the closing table so that they don’t impact the parties acquiring the property.

The Title Examination Process

During the title examination, your title insurance company will review the chain of title to the property in question. That means going through the history of ownership for the property as far back as it goes. Depending on the age of the property and the quality of record-keeping this can be an arduous process. In any case, the title searcher will find anything that might cause a cloud on the title. Once any defects are resolved, the title company will then provide the buyer or lender with a title insurance policy that covers their interests in the property moving forward.
